The survival of the well-known TV journalist Gunel Gozalova's spouse Anar Gozalov, who faced a risk of death as a result of medical negligence, is clear to the public.
The trial of Araz Bayramov, a urologist responsible for the lawsuit filed by Gunel Gozalova, representing the victim Anar Gozalov, has been dragging on for almost nine months.
Today, the Court of Appeal held its first hearing chaired by Judge of the court Mammad Mammadov. The trial, which lasted more than half an hour, was postponed to next week due to a lack of evidence from defendant Araz Bayramov's lawyer, Asif Madatov, and a lack of documents required by the judge. It should be noted that less than a day before the date of the hearing, the complainant (plaintiff) Gunel Gozalova's lawyer Elchin Sadigov refused to attend the trial, stating that he had important work to do. For this reason, the plaintiff Gunel Gozalova was represented in court without a lawyer and defended her husband alone.
It is strange that this illegal action of human rights activist Elchin Sadigov raises questions for me personally, both as a journalist and as a citizen. In any case, no court shall appoint a court without the consent of the lawyers of both parties.
The lawayer Elchin Sadigov has expressed to Gunel Gzoalova the lack of his ability to attend the court through his assistant due to his busy schedule. It is strange that Mr. Sadigov, a lawyer, has realized that he had been overworked for the last 22 hours prior to the start of trial, which has taken about a month !? Well anyway... The trial took place place, with Elchin or without Elchin!
After the court hearing, the plaintiff Gunel Gozalova has answered journalists' questions:
"It is true that I am present without a lawyer, but this trial is more heartwarming than others. I do not know what will happen in the next stage. But I must say that after the trial chaired by Mammad Mammadov, I have high hopes. Vugar Guliyev, who was taken from the court today and made an unfair and illegal decision in our court, did not address any of the questions asked by the judge to the other side. Although these were very simple questions. If everyone in their right mind was not biased, they had to look at the documents, listen to the complainant, and finally address the defendants to the defendant if they were human. For example, Judge Mammad Mammadov and the board member Sheyda Maharramova had the expert opinion of the Forensic Medical Expertise and Pathological Anatomy Association. Considering the patient's diabetes, arterial hypertension and some changes in the hemogram in the preoperative period, it would be advisable to consult an endocrinologist, cardiologist and hematologist. Defendant's lawyer Asif Madatova was asked questions about the case. The man gave ridiculous answers: "You know how, of course, all the examinations were carried out. The patient was treated by Araz Bayramov for a long time and everything was done before the operation. My relatives also died in such cases. This does not mean that the surgeon is guilty. And we all know that what is required is done according to the official protocol. He laughed, saying that these were not always carried out according to protocol. The defendant's lawyer from the first trial is trying to ridicule us as much as possible in court. Of course, it's ridiculous in the end! ”
Plaintiff Gunel Gozalova also explained the current state of his wife's health:
"Anar is recovering as a result of a year of multidisciplinary treatment in various clinics and countries. He is on his feet, since he left the clinic. He just didn't know people for a long time, he couldn't control himself, he's getting better. Speech therapist-defectologist treatment must be at least 2 years, even a neurologist from Israel prof. Veller (Horev Medical Center, Haifa, Israel) claimed that the patient would decline if he cedes this treatment. Of course, professional neurologists consider it impossible to fully restore speech and comprehension defects. Without delayed treatments, perhaps there would be fewer defects today. As a result of an examination at Anadolu Hospital in Istanbul last week, neurologists said there was always a risk to life due to a bilateral stroke and subarchanoid hemorrhage during the operation.
In short, I must say that I, like any journalist, have unanswered questions because I am closely acquainted with the course of the issue. Defendant Araz Bayramov claims that he spent 4,000 manat from his budget to treat his patient Anar Gozalov. He said in an earlier statement that he bought many expensive medicine at his own expense. I wonder why? What made Araz Bayramov do this kindness that no doctor does today? Perhaps Mr. Bayramov tried to wash away his "sins" and clear his conscience ?! Doesn't his statement in itself expose the doctor's guilt, what do you think ?!
Although I had to address this question to urologist Araz Bayramov, we did not meet him in the courtroom. His lawyer fled and disappeared. Although I am fully aware of the issue, there are still dark points around the topic. Let's hope that we will find the answers to these questions at the next meeting.
The patient's spouse Gunel Gozalova said she would publicize the date of the next trial.
